MUNICIPAL LAW
Miller Law Office, P.A. currently represents four (4) municipal
clients. Miller Law Office, P.A. has experience in all facets of
the civil issues facing the cities, including, without limitation,
the following:
1. Attendance
at and advice regarding the conduct of City Council, Economic
Development Authority, and Planning Commission Meeting.
2.
Negotiating, drafting, closing and enforcing various development
and land use related transactions and documents, including
Development Agreements, Planned Unit Development Agreements, Tax
Abatement Development Agreements, Tax Increment Development
Agreements, Variances, Conditional Use Permits, Purchase and Sales
Agreements, Title Insurance, and preliminary and final plat
review.
3. Working
with the City’s employed and consulting staff regarding the City’s
needs relating to public improvements, plan review and ordinance
interpretation and enforcement.
4.
Representing the City in eminent domain proceedings, consisting of
quick-take and non quick-take condemnation actions, negotiated
settlements in lieu of condemnation, access control agreements,
and direct purchase for purposes of public projects such as street
and bridge projects and other similar matters, including general
advice regarding the state and federal relocation assistance
requirements.
5.
Representing the City in special assessments for public
improvements under Minn. Stat. Chapter 429, including consulting
with the City staff and City Engineer regarding the steps and
forms necessary to properly proceed with the assessment process
and the representation of the City in assessment appeals resulting
from such assessments.
6. Annexation
of Property into the City, either by way of an annexation by
ordinance or by an orderly annexation process pursuant to a joint
resolution.
7.
Representing the City before the County and Town Boards and State
agencies, as necessary.
8. Providing
employment law advice to the City including preparation of
employment agreements, separation agreements, labor negotiations,
arbitrations, mediations, unemployment compensation appeals,
workers compensation claims and the defense of discrimination of
harassment claims.
While the above list is extensive, it does not begin to identify
the vast number of issues which fact the City on a day-to-day
basis including, without limitation, civil litigation involving
the City to the extent such litigation is not defended by the City
Insurance carrier, open meeting law advice, general legal advice
relating to the City Financing (exclusive as serving as bond
counsel) including such items as short-terms loans, equipment
certificates and the like. |
