Thomas
F. Miller: |
Thomas F. Miller was born in Princeton, Minnesota and graduated
from Princeton High School in 1969. Mr. Miller has resided in
Chisago County, Minnesota for the last thirty-three (33) years. Mr.
Miller is a 1973 graduate of Hamline University, has a Masters
Degree from St. Cloud State University, and is a 1984 Magna Cum
Laude Graduate of William Mitchell College of Law. Mr. Miller was
admitted to the Minnesota State Bar in May of 1984 and has been a
practicing attorney in the State since that time. Mr. Miller has
been a shareholder with a large Twin Cities law firm, Felhaber,
Larson, Fenlon & Vogt, P.A.; a shareholder
with the Forest Lake law firm then known as Hebert, Welch,
Humphreys & Miller, P.A., and is currently the sole shareholder
of MILLER LAW OFFICE, P.A. Mr. Miller practices in all areas of
general governmental/civil law and has a great deal of practical
experience in the areas of land use, real estate, zoning,
regulation enforcement, development transactions, employment law,
ordinance drafting, interpretation and enforcement.

Mr. Miller has over
fifteen (15) years of experience in all facets of the
civil issues facing the cities, including, without
limitation, the following:
1. Attendance at and
advice regarding the conduct of City Council, Economic Development
Authority, and Planning Commission Meetings.
2.
Negotiating, drafting, closing and enforcing various development
and land use related transactions and documents, including
Development Agreements, Planned Unit Development Agreements, Tax
Abatement Development Agreements, Tax Increment Development
Agreements, Variances, Conditional Use Permits, Purchase and Sale
Agreements, Title Insurance, and preliminary and Final Plat
review.
3.
Working with the City's employed and consulting staff regarding
the City's needs relating to public improvements, plan review and
ordinance interpretation and enforcement.
4.
Representing the City in eminent domain proceedings, consisting of
quick-take and non quick-take condemnation actions, negotiated
settlements in lieu of condemnation, access control agreements,
and direct purchase for purposes of public projects such as street
and bridge projects and other similar matters, including general
advice regarding state and federal relocation assistance
requirements.
5.
Representing the City in special assessments for public
improvements under Minn. Stat. Chapter 429, including consulting
with the City's staff and City Engineer regarding the steps and
forms necessary to properly proceed with the assessment process
and the representation of the City in assessment appeals resulting
from such assessments.
6. Annexation of property
into the City, either by way of an annexation by ordinance or by
an orderly annexation process pursuant to a joint resolution.
7. Representing the City
before County and Town Boards and State agencies, as necessary.
8.
Providing employment law advice to the City including preparation
of employment agreements, separation agreements, labor
negotiations, arbitrations, mediations, unemployment compensation
appeals, workers compensation claims and the defense of
discrimination or harassment claims.
While the above
list is extensive, it does not begin to identify the vast number
of issues which face the City on a day-to-day basis including,
without limitation, civil litigation involving the City to the
extent such litigation is not defended by the City's insurance
carrier, open meeting law advice, and general legal advice
relating to the City's financing obligations (exclusive of serving
as bond counsel) including such items as short-term loans,
equipment certificates and the like.
Thus, as
summarized above, Mr. Miller has significant legal experience in
all areas of the civil side of the Firm's governmental practice
and has been directly involved in numerous complicated
transactions between the City of Wyoming, developers and other
third parties. For example, Mr. Miller represented the City of
Wyoming in negotiations with Fairview Hospital regarding its
acquisition of land, annexation, rezoning and construction of a
new hospital facility within the City of Wyoming. Additionally,
Mr. Miller has represented employers and corporations in all
manners of labor negotiations, arbitrations, and mediations.
Finally, Mr. Miller is a certified civil arbitrator and mediator.
